Do I need an attorney to buy a house? In Connecticut yes, in Alabama no

One of the biggest practical differences between my two markets, and the one that surprises people moving between them.

I work in Connecticut and North Alabama, and this is the difference that trips people up most when they move between them.

Connecticut: yes, you need an attorney

Connecticut is an attorney-state for real estate closings. You hire a real estate attorney, and they are involved through most of the transaction, not just the last day.

Your attorney reviews and finalizes the purchase and sale agreement, handles the title search, and runs the closing itself. You sign with your attorney. Budget for that fee from the beginning, because it is not optional and it is not a surprise you want at the end.

Connecticut also uses a binder, which confuses almost everyone coming from out of state. When your offer is accepted you put down a binder deposit to hold the deal. Then your attorney reviews everything, the purchase and sale agreement gets finalized, and the rest of your deposit goes down. Two steps, not one.

Alabama: no attorney required

In Alabama, a title company typically handles the closing. There is no attorney review period built into the process the way there is in Connecticut, and no binder. Your offer is accepted, you put down earnest money, and the clock starts.

That makes the Alabama timeline feel faster and simpler, which is mostly true. It also means there is no attorney review window to catch something, so the inspection period and your agent’s read on the contract carry more weight.

Why this matters if you are moving between them

If you are coming from Alabama to Connecticut, budget for the attorney and do not be alarmed by the two-stage deposit. It is normal here.

If you are going the other way, do not assume you will get an attorney review period to fix something after the fact. You will not.
